In addition to the federal laws and regulations, Minnesota state law (Statute 123B.03 - Background Check) requires written notification before the information for the background check is gathered. This notification must include a place for the subject of the check to sign to formally authorize the release of detailed personal information to the investigating agency. If the background check is performed as part of an employment interview process, the form must include a check box for the applicant to request a copy of any information gleaned as part of the background check process.
